Dispute Prevention and Resolution

Disputes within a team or organization can lead to poor morale and performance. Are you doing everything you can to avoid a dispute? Equally it is important to have an internal process to deal with disputes quickly and fairly, when they arise.

SIRC is pleased to partner with the Sport Dispute Resolution Centre of Canada (SDRCC) to bring you the latest information and resources on preventing and resolving disputes.  The SIRC Seminar on February 12th will feature Allan Stitt, Chair of SDRCC and Marie-Claude Asselin, Executive Director and CEO of SDRCC.

Dealing with Disputes Internally

Offering an internal appeal process that is fair and coherent with the rules of natural justice will increase your organization’s credibility in the eyes of your members and help preserve relationships within your closely-knit community. Resolution Facilitation : The Alternative that Works

A Resolution Facilitator (RF) can help people work through sports-related disputes, understand how arbitrations might be conducted, and solve problems that need not go to arbitration. In a consultation session with an RF, the focus will be on the parties’ underlying interests to help them find a workable resolution that they can all accept. The RF can also inform people involved in sports disputes about what might happen at arbitration, based on how other similar cases were resolved in the past

Preventing Team Selection Disputes

Responsible NSOs recognize the importance of a sound team selection policy to ensure that the best athletes are indeed selected, and also to avoid disputes leading up to a major competition. When such disputes arise just before an important event, they are disruptive for the entire team and they take the focus of the athletes away from their sport preparation. There are many ways to prevent team selection disputes and many people have an important role to play in this process: the NSOs, the coaches and the high performance staff, as well as the athletes themselves.

When athletes who were not nominated by the sport federation for financial support from Sport Canada’s Athlete Assistance Program believe that they have grounds to appeal this decision, they can come to SDRCC for assistance. But before that, they must do their homework.

Keeping the Peace
